1. Parties

a) Dogu Travel Company (hereinafter referred to as “dogutravel”), located at Kocatepe Mah Abdulhakhamit Cad No: 28/7 Taksim Beyoğlu / İstanbul, which operates the www.dogutravel.com website.

b) Internet user who is a member of the www.dogutravel.com website (“Member”)

2. Subject of the Agreement

The subject of this Agreement is to determine the terms of use of the www.dogutravel.com website owned by dogutravel.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided by the Member while becoming a member of the www.dogutravel.com website is correct before the law, and that Dogutravel will compensate all damages it may incur due to the inaccuracy of this information in full and immediately.

3.2. The Member cannot give the password given to him/her by Dogutravel to other persons or organizations, and the Member has the right to use the said password. For this reason, against all liability that may arise and all claims and demands that may be made against dogutravel by third parties or authorized authorities, dogutravel reserves the right to demand compensation and other claims arising from such unauthorized use.

3.3. The member accepts and undertakes to comply with the provisions of the legal legislation and not to violate them while using the www.dogutravel.com website. Otherwise, all legal and criminal liabilities that may arise will bind the member completely and exclusively.

3.4. The member may not use the www.dogutravel.com website in any way that disrupts public order, is against general morality, disturbs and harasses others, for an illegal purpose, or infringes on the intellectual and copyrights of others. In addition, the member may not engage in activities and actions that prevent or make it difficult for others to use the services (spam, virus, trojan horse, etc.).

3.5. The ideas and thoughts declared, written and used by members on the www.dogutravel.com website are entirely the members' own personal opinions and are binding on the opinion owner. These opinions and thoughts have no relation or connection with dogutravel.
dogutravel has no responsibility for the damages that third parties may suffer due to the ideas and opinions expressed by the member and for the damages that the member may suffer due to the ideas and opinions expressed by third parties.

3.6. dogutravel shall not be responsible for the reading of member data by unauthorized persons and for damages that may occur to member software and data. The member has accepted in advance not to claim compensation from dogutravel for any damages that may be suffered due to the use of the www.dogutravel.com website.

3.7. The member has accepted not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this shall be entirely the responsibility of the member.

3.8. The member who violates one or more of the articles listed in this membership agreement shall be personally and legally liable for this violation and shall hold dogutravel harmless from the legal and penal consequences of these violations. In addition; if the incident is brought to the legal field due to this violation, dogutravel reserves the right to claim compensation from the member due to non-compliance with the membership agreement.

3.9. dogutravel always has the right to unilaterally delete the member's membership and delete the customer's files, documents and information when necessary. The member accepts this disposition in advance. In this case,
dogutravel has no responsibility.

3.10. www.dogutravel.com website software and design
are the property of dogutravel, the copyright and/or other intellectual property rights related to them are protected by the relevant laws and they cannot be used, acquired or changed by the member without permission. Other companies and products mentioned on this website are the trademarks of their owners and are also protected within the scope of intellectual property rights.

3.11. Some information may be collected by dogutravel for the purpose of improving and developing the www.dogutravel.com website and/or within the framework of legal regulations, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time the site was accessed, the pages accessed while on the site and the Internet address of the Web site that provides direct connection to the site.

3.12. dogutravel may use the personal information of members in studies regarding the special preferences and interests of its users in order to provide better service to its users, improve its products and services, and facilitate the use of the site. dogutravel reserves the right to keep a record of the member's actions on the www.dogutravel.com website.

3.13. The person who becomes a member of dogutravel may receive product and service promotions, advertisements, campaigns, advantages within the scope of the current and/or future practices.

The member declares and accepts that he/she allows the presentation of surveys, customer satisfaction applications and other customer satisfaction applications. The member declares and accepts that he/she allows contact using communication channels such as internet, telephone, SMS, etc. The member declares and accepts that he/she will not claim and will not hold dogutravel responsible for any direct and/or indirect material and/or moral negative and/or positive damages due to the collection, sharing, use, archiving and access to the above-mentioned information. If the member wishes to change his/her data sharing preferences, he/she can forward this request to dogutravel's customer service call center.

3.14. dogutravel may disclose the member's personal information when requested as a legal obligation or in cases where it is believed in good faith that it is necessary to act in accordance with legal requirements or to comply with legal transactions notified to dogutravel; to protect and defend the rights and property of dogutravel and the dogutravel website family.

3.15. Measures have been taken within the available means to ensure that the dogutravel website is free of viruses and similar software. In addition, in order to ensure ultimate security, the user must provide their own virus protection system and provide the necessary protection. In this context, by entering the dogutravel website, the member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.16. dogutravel reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete user information and data registered on the dogutravel website.

3.17. dogutravel may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning in any form or manner. Every provision that is changed, updated or repealed will be effective for all members on the date of publication.

3.18. The parties accept and declare that all computer records belonging to dogutravel will be taken as the sole and real exclusive evidence in accordance with Article 287 of the Civil Procedure Code and that the records in question constitute an evidentiary contract.

3.19. In accordance with this membership contract, dogutravel is authorized to send information e-mails to its members' registered e-mail addresses and information SMSs to their mobile phones. The member will be deemed to have accepted the sending of information e-mails to their e-mail addresses and information SMSs to their mobile phones by approving this membership contract. If the member wishes to stop receiving e-mails and/or SMSs, they can cancel the sending of e-mails and/or SMSs from the "Information Preferences" section in the "My Account" section.

4. Termination of the Contract

This contract will remain in force until the member cancels their membership or their membership is canceled by dogutravel. In the event that the member violates any provision of the membership contract, dogutravel may cancel the member's membership and terminate the contract unilaterally.

5. Resolution of Disputes

Istanbul Courts and Enforcement Offices are authorized in disputes regarding this agreement.

6. Enforcement

The member's registration for membership means that the member has read all the articles in the membership agreement and has accepted the articles in the membership agreement. This Agreement has been concluded and entered into force mutually at the time the member becomes a member.
